GENERAL TERMS AND CONDITIONS OF ONLINE SALE
(Version: September 2025)
These general terms and conditions of sale (hereinafter also "Terms and Conditions of Sale" or "T&C") govern in detail the sale of products offered by LEGAMI S.p.A. Benefit Company (hereinafter also "LEGAMI" or "Seller"), REA BG-335305 VAT No. 02937550164, with registered office in Azzano San Paolo (BG), Via Stezzano 18, through the e-commerce website www.legami.com (hereinafter "Website").
The Customer is required to carefully read these Terms and Conditions of Sale before placing an Order. The current version of these Terms and Conditions of Sale can be downloaded and printed at https://www.legami.com/en_en/general-terms-and-conditions.html.
Acceptance of the Terms and Conditions of Sale when placing an Order is a mandatory requirement to purchase the Products. Failure to accept the Terms and Conditions of Sale makes it impossible to purchase the Products.
These Terms and Conditions of Sale apply equally to all Customers except where expressly provided otherwise for Consumer Customers.
1. DEFINITIONS
1.1 For the purposes of these Terms and Conditions of Sale, the following definitions apply:
- "Legami Boutiques": Legami brand retail stores in Italy;
- "Click & Collect Boutiques": Legami Boutiques where Orders placed online can be collected, as better detailed in article 7.7, better indicated at the following link: https://www.legami.com/en_en/store-locator.html;
- "Consumer Code": Legislative Decree 6 September 2005, No. 206;
- "Terms and Conditions of Sale or T&C": these general terms and conditions of sale;
- "Order Confirmation": the automatic email that the Customer receives when placing an Order on the Website and which confirms the correct receipt of the Order by the computer system;
- "Contract": the distance contract concluded between LEGAMI and the Customer;
- "Customer": any subject, natural or legal person, Professional Customer or Consumer Customer, who places an Order through the Website;
- "Consumer Customer": the natural person who purchases Products for purposes unrelated to any business or professional activity, as defined by art. 3, paragraph 1, letter a) of the Consumer Code;
- "Professional Customer": the natural or legal person who purchases Products in the exercise of their activity;
- "Gift Card": payment card for purchasing Products in Legami Boutiques and on Legami.com;
- "Order": the purchase proposal sent by the Customer;
- "Product(s)": the material good(s) with LEGAMI brand marketed through the Website;
- "Product Sheet": the description of the Product published on the Website containing the main characteristics, price, images, availability information and estimated delivery times;
- "Website": the e-commerce www.legami.com.
2. CONTRACT OBJECT
2.1 These Terms and Conditions govern the offer, submission and acceptance of an Order for Products made by the Customer through the Website.
2.2 The Products include stationery and office supplies, home and kitchen accessories, gift ideas, objects and gadgets, travel and leisure items, personal care and clothing items, games and pastimes, sports and hi-tech items and accessories with LEGAMI brand; the services made available by the Website are those connected with the sale of the aforementioned Products. All Products and services offered are detailed on the Website, within their respective sections.
3. PRE-CONTRACTUAL INFORMATION
3.1 It is the Customer's responsibility, before sending an Order, to carefully read the characteristics of the Products illustrated in the Product Sheet on the Website.
3.2 Before sending the Order, Consumer Customers will receive the following information regarding the Products, as provided by articles 49 et seq. of the Consumer Code:
- main characteristics of the Products;
- identity, address and contact details of the Seller;
- total price, including taxes and shipping costs;
- payment, delivery, execution and complaint handling methods by the Seller;
- conditions for exercising the right of withdrawal;
- existence of legal guarantee of conformity and any commercial guarantees;
- after-sales assistance conditions.
4. PURCHASE PROCEDURE
4.1 The Customer acknowledges that the presentation of Products on the Website does not constitute a binding sales offer by the Seller, but merely an invitation to present an offer for the purchase of Products by the Customer.
4.2 When the Customer places an Order by clicking the "CONFIRM PURCHASE" button, they are making a binding offer to conclude a Contract for the Products in the cart. Order data (item, quantity, personal data, shipping and payment methods) are displayed in the last phase of the order process and can be corrected until the "CONFIRM PURCHASE" button is clicked. The Seller recommends checking all data before placing the order and confirming payments.
4.3 The successful receipt of the Order is confirmed by LEGAMI by sending the Order Confirmation, through an automatic response sent to the email address provided by the Customer, which exclusively confirms the correct receipt of the Order by the computer system. This Order Confirmation will indicate the "Customer Order Number" to be used for any subsequent communication with LEGAMI. The message reproduces a summary of the Order, with indication of Products, prices and shipping costs, as well as all data entered by the Customer, who undertakes to verify their correctness.
4.4 Once an Order has been sent and without prejudice to the provisions of article 8 below, the Customer has the option, within 15 minutes of receiving the Order Confirmation, to cancel the Order itself by accessing their personal area.
4.5 Once the Order Confirmation has been received, the Customer acknowledges and accepts that neither the Customer nor Legami Customer Service will be able to modify billing data, shipping data, payment method and ordered Products.
4.6 The Order Confirmation only documents that the Order has been received and does not constitute acceptance of the Order by the Seller. Without prejudice to the provisions of subsequent article 5.4, if Products are not available, LEGAMI informs the Customer by email and refunds without delay any advance payment to the original payment method.
4.7 The Order constitutes a contractual proposal pursuant to article 1326 of the Italian Civil Code. The Contract is considered concluded only when the Customer receives formal acceptance confirmation from the Seller and only in relation to the Products listed in the Order acceptance confirmation.
4.8 The Seller is not obliged to accept the Customer's Order and may refuse acceptance at any time at its discretion (for example, if Products are not available or if it is evident or suspected that the Customer violates the Terms and Conditions of Sale). In this case, the Customer is informed by email that the Order has not been accepted and payments already made are fully refunded as soon as possible.
4.9 The Seller reserves the right to refuse abnormal orders or orders not compliant with its commercial policies.
4.10 Photographs of Products presented on the Website do not constitute a contractual element, as they are to be considered only representative.
4.11 With the Order Confirmation or at the latest upon delivery of Products, the Seller sends the Customer the Contract (composed of the Order and Terms and Conditions of Sale) on a permanent data medium (such as an email or paper printout). In case of shipment by email, it is possible to view the email and print it or save it. The Seller stores and processes the text of the Contract in accordance with applicable data protection laws.
5. PRODUCT AVAILABILITY
5.1 Product availability is updated in real time but not guaranteed until Order confirmation.
5.2 The Seller does not assume the risk of having to procure Products ordered by the Customer (supply risk).
5.3 In case of subsequent unavailability, the Customer will be informed as soon as possible. In the absence of alternatives, the Order will be cancelled and the amount refunded.
In case of subsequent partial unavailability relating to only one or more of the Products included in the Customer's Order, the Seller reserves the right to proceed with partial deliveries limited to available Products. The Order will instead be cancelled – and the corresponding amount refunded – with reference to unavailable Products.
5.4 The Seller reserves the right to establish, at its discretion, a maximum limit of units of each Product purchasable by the same Customer, in order to prevent hoarding and/or unauthorized resale phenomena. This limit will be indicated on the Website in correspondence with each interested Product. Should the Customer wish to place an Order that exceeds this threshold, they may submit a request to LEGAMI's sales department by filling out the Contact Us form, available within the Frequently Asked Questions section. The Seller reserves the right to accept or refuse this request at its sole discretion.
6. PRICES AND PAYMENT METHODS
6.1 Prices are expressed in Euros, VAT included, and do not include shipping costs, which will be shown separately during purchase.
6.2 The Customer can make payment by credit card, PayPal, Satispay, Apple Pay, Google Pay, Bank Cards or through Gift Card, whether purchased online or in one of the Legami Boutiques. The Customer will be required to choose, when concluding the Order, the preferred payment method. The latter, once the Contract has been finalized through acceptance of the Order by LEGAMI, can no longer be modified.
6.3 Should LEGAMI encounter payment-related issues, it will promptly notify the Customer, inviting them to submit a new Order, selecting a different payment method, always among those accepted.
6.4 Should the Customer proceed to purchase Products with payment by credit card, the referring banking institution will immediately verify the validity of the credit card, but will charge the total amount corresponding to each Order only when the Order is shipped by the Seller, it being understood that a preventive block of the sum equal to the Order consideration will be made on the Customer's credit card. Information relating to the purchaser's credit card will be transmitted via protected connection directly to the website of the banking institution managing the transaction. In compliance with sector regulations, such data will be acquired by Adyen at LEGAMI's request and used to proceed with payment transactions. LEGAMI reserves the right to request additional information from the Customer at any time (e.g. telephone number) necessary for Contract execution or sending copies of documents proving ownership of the credit card used for Order completion. In the absence of sending the requested information or documentation by the Customer, LEGAMI reserves the right not to accept the Order or to terminate the Contract if the failure to send information does not allow Order execution, giving simultaneous reasoned communication to the Customer at the provided email address.
6.5 Should the Customer choose PayPal as payment method, they will be redirected to the www.paypal.com website where they will execute product payment according to the procedure provided and regulated by PayPal. Data entered on the PayPal website will be processed directly by PayPal and will not be transmitted or shared with LEGAMI. In cases of Contract termination and in any other case of refund, for any reason, the refund amount will be credited to the Customer's PayPal account. The re-crediting times on the payment instrument connected to such account depend exclusively on PayPal and the banking system. Once the credit order in favor of such account has been arranged, LEGAMI cannot be held responsible for any delays or omissions in crediting the Customer with the refund amount, which the Customer must address directly to PayPal to contest.
6.6 The Customer can purchase a Gift Card on the Website or at one of the Legami Boutiques. The Gift Card has a validity of 12 months from the purchase date and can be used in one or more solutions, until credit exhaustion or expiry date. After the validity period, it will not be possible to obtain a refund of the residual credit. The balance and validity date of the Gift Card can be verified through the following link [-]. 7. DELIVERY METHODS
7.1 Products will be delivered to the address indicated by the Customer, through a courier selected by the Seller, or at one of the Click & Collect Boutiques. Normally, for each Order with an amount equal to or less than €48.99, additional flat-rate shipping costs will be applied, which vary based on the destination country. Shipping costs will be calculated automatically by the Website and will be viewable and knowable by the Customer before sending the Order. The Seller will have the right to modify shipping costs if deemed necessary. 7.2 The Seller will use its best efforts to ensure that Products are delivered within 7 working days if delivery is made in Italy or 10 working days if delivery is made in the European Union and/or abroad.
7.3 Products are delivered in accordance with the Terms and Conditions of Sale only to the countries indicated on the Website, viewable at the following link: [INSERT LINK TO COUNTRIES WHERE YOU SHIP].
7.4 The Customer is informed of delivery times both in the page containing product information regarding Products, in the cart, at the time of payment and in the Order confirmation email.
7.5 Upon delivery, the Customer is required to verify the integrity of the package and the quantitative and qualitative correspondence of Products with what is indicated in the Order Confirmation email received by the Customer. Any discrepancies must be promptly reported to the Seller through the Contact Us form available on the Legami website, available at the following link: [INSERT LINK TO CONTACT US FORM].
7.6 Delivery is considered completed with the release of Products to the Customer or to a person appointed by them, or to the address indicated by the Customer, in case of delivery through couriers such as, by way of example, Amazon Shipping. The risk of loss or damage to Products is transferred to the Customer only upon physical delivery of the Products themselves.
7.7 It is possible to collect Orders placed on the Website at Click & Collect Boutiques. During the order procedure, it is possible to verify if the collection option at one of the Legami Boutiques is available for the delivery country.
8. CONSUMER CUSTOMER'S RIGHT OF WITHDRAWAL
8.1 Consumer Customers have the right to withdraw, without obligation to provide reasons, within 14 days from the date of receipt of Products.
8.2 The Consumer Customer's right of withdrawal is exercised by sending a simple written communication by registered mail with return receipt, certified email or online form present on the Website at the following link: [INSERT LINK TO WITHDRAWAL FORM].
8.3 Consumer Customers must return Products at their own expense within 14 days of withdrawal communication, in intact conditions and in original packaging, following the instructions better specified at the following link: [INSERT LINK TO RETURN CONDITIONS].
8.4 The refund will be made within 14 days of receipt of Products or proof of shipment, using the same payment method indicated in the Order.
8.5 The right of withdrawal is excluded for custom-made or personalized products; sealed products that are not suitable for return for hygienic reasons, if opened; perishable or rapidly deteriorating goods.
9. LEGAL GUARANTEE OF CONFORMITY
9.1 Consumer Customers have the right to legal guarantee of conformity pursuant to articles 128-135 of the Consumer Code, valid for 24 months from Product delivery.
9.2 The conformity defect must be reported by the Consumer Customer to the Seller within 2 months from the date of its discovery, under penalty of forfeiture of the right, by filling out the Contact Form available on the Website at the following link: [INSERT LINK TO CONTACT FORM FOR DAMAGED ITEMS].
9.3 In the presence of a conformity defect, which will be ascertained by the Seller upon return of Products, Consumer Customers have the right to remedies provided by articles 135bis-135quater of the Consumer Code.
9.4 Professional Customers have the right to warranty for defects provided by articles 1490 et seq. of the Civil Code, applicable for a maximum period of 12 months from Product delivery, with obligation to report within 8 days of discovery.
10. LIABILITY
10.1 The Seller is not responsible for service failures or delays in Order execution attributable to force majeure causes, fortuitous events, third party acts or unforeseeable events not attributable to its conduct, such as, by way of example only, pandemics, epidemics, natural disasters, adverse weather conditions, fires, floods, earthquakes, strikes, sabotage, incorrect functioning and/or failures and/or interruptions and/or defects of any other type of telephone, electrical lines and communication networks.
10.2 All liability for indirect damages, loss of profits, commercial opportunities or damages not directly attributable to violation of these Terms and Conditions of Sale is excluded.
11. PROFESSIONAL CUSTOMERS
11.1 Professional Customers acknowledge that the purchase is made in the exercise of their activity and therefore do not benefit from the protections provided for Consumer Customers.
11.2 Professional Customers are not subject to Consumer Code provisions relating to right of withdrawal, legal guarantees, pre-contractual information and extrajudicial protection.
11.3 Professional Customers will have the right exclusively to warranty for defects pursuant to article 1490 et seq. of the Civil Code, under the conditions and terms referred to in the previous article 9.4.
11.4 Any request for order cancellation by a Professional Customer must be expressly accepted by LEGAMI.
12. COMMUNICATIONS AND COMPLAINTS
12.1 Any communication or complaint may be forwarded to LEGAMI through the appropriate form in the "Contact Us" section of the Website, available at the following link: [INSERT LINK TO CONTACT US FORM].
12.2 LEGAMI undertakes to respond to communications within a reasonable time.
13. APPLICABLE LAW AND COMPETENT COURT
13.1 These Terms and Conditions of Sale are governed by Italian law.
13.2 For any dispute relating to the application, execution, interpretation and violation of these Terms and Conditions of Sale referring to Consumer Customers, the Court of the place of residence or elective domicile of the Consumer Customer is competent, if located in the territory of the Italian State. In any other case, the Court of Bergamo will be competent.
14. PRIVACY
14.1 Personal data collected is processed in compliance with current regulations on personal data protection (EU Reg. 679/2016 and Legislative Decree 196/2003, as amended by Legislative Decree 101/2018).

Pursuant to articles 1341 and 1342 of the Civil Code, the Customer declares to have read and specifically accept the following articles of these Terms and Conditions of Sale:
